Garby LLC Terms of Service.

TERMS OF SERVICE ---- Terms of Service Contract This Terms of Service Contract (the "Contract") is entered into between Garby LLC (referred to as the "Company") and the customer (referred to as the "Customer"). 1. Services Rendered 1.1 The Company agrees to provide trash, recycling, and yard waste collection (during specified seasons) to the Customer. 1.2 The Customer agrees to make timely payments as outlined in this Contract and in accordance with the Company's billing schedule. 2. Waste Materials 2.1 The Customer shall comply with the waste materials guidelines provided by the Company, as outlined in the "Statement of Services" document and in accordance with the waste disposal regulations of the county in which they reside. 3. Service Frequencies and Billing 3.1 The Customer may choose a period for billing at checkout, with options for monthly, every 3 months, or annually. 4. Payments and Late Fees 4.1 The Customer shall make payments to the Company within 14 days after receipt of an invoice. 4.2 In the event of late payment, the Customer agrees to pay a late fee equal to 10% of the outstanding balance. 5. Termination 5.1 If the Customer decides to terminate the services under this Contract, they must provide written notice to the Company at least 30 days prior to the desired termination date. 6. Severability 6.1 If any provision of this Contract is found to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in effect. The invalidity or unenforceability of any provision of this Contract shall not affect the overall validity or enforceability of the remaining provisions of the Contract. 7. Governing Law 7.1 This Contract shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. 8. Changes to the Contract 8.1 You can review the most current version of the Contract at any time at this page. 8.2 We reserve the right, at our sole discretion, to update, change or replace any part of these Contract by posting updates and changes to our website. It is your responsibility to check our website (payments.getgarby.com/terms) periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Contract constitutes acceptance of those changes. 9. Use of Customer's Bins 10.1 The Customer has the option to use their own bins for waste disposal and recycling purposes. However, the suitability and appropriateness of such bins for the Company’s service operations are subject to the discretion of the Company. 10.2 If the Company determines that a Customer's bin is unsuitable or inappropriate for the Company’s operations, the Company reserves the right to request that the Customer use bins provided or approved by the Company. 10.3 The Company is not liable for any damages or wear to Customer's own bins resulting from the normal collection process. 11. Bin Retrieval Upon Termination 11.1 In the event that the Customer terminates services and the Company is unable to retrieve the Company-provided bins within 30 days of service termination, the Customer owes the Company a sum of $100 per bin. 11.2 The amount shall be paid to the Company within 14 days after the aforementioned retrieval period ends. 11.3 If the Company-provided bins are damaged, lost, or rendered unusable by the Customer, this clause may be deemed void at the discretion of the Company. By paying for the services provided by the Company, the Customer agrees to the terms and conditions outlined in this Contract.
